Terms of Service

These terms are the agreement between PlatePost and the restaurant or business that subscribes to it. By creating an account, subscribing to a plan, or using the service, you agree to them.

Guests who simply scan a QR code and look at a menu are not entering into this agreement. If that's you, the Privacy Policy is the page you want.

What PlatePost provides

PlatePost converts the menu you already have into a video menu, and hosts it on a table QR code, TV displays, tablets, and a link you can put in a bio. Depending on your plan this includes filming or generating video for your dishes, translations, allergen and dietary tags, an AI assistant for guests, analytics, and unlimited menu updates.

We may improve, change, or retire individual features over time. If we remove something material from a plan you are paying for, we will tell you first.

Your account

You are responsible for what happens under your account, including keeping your sign-in details private and making sure the people you invite should have the access you give them. Tell us promptly if you think someone has gained access they shouldn't have.

You must be able to enter into a contract on behalf of the business you are signing up, and you must be at least 18.

Plans, billing, and cancellation

  • Plans start at $100 per month for one location. Current plans and what each includes are listed on the pricing page.
  • Subscriptions renew automatically — monthly or annually, depending on what you chose — until you cancel.
  • Payment is taken by Stripe. By subscribing, you authorise recurring charges to your payment method.
  • You can cancel at any time. Cancellation stops the next renewal; it does not retroactively refund the period you are currently in, and your menu stays live until the end of that period.
  • Annual plans that include a hardware kit are billed for the full year up front. If you cancel an annual plan early, the hardware kit is not refunded.
  • We may change prices. Existing subscriptions keep their price until the next renewal, and we will give at least 30 days' notice before a change takes effect.
  • If a payment fails, we will retry and email you. Persistent non-payment can result in the menu being suspended.

Your content, and what we may do with it

Your menu, your photos, your videos, your logos, and your restaurant's name remain yours. Nothing here transfers ownership to us.

You give PlatePost permission to host, store, resize, transcode, translate, and display that content for the purpose of running your menu — which is what makes the product work. That permission ends when you delete the content or close your account, except for backups that age out on their normal schedule.

You also give us permission to show your restaurant's name, logo, and menu as an example of PlatePost's work — on our website, in our discovery directory, and in sales material. If you would rather we didn't, email us and we will remove it.

You confirm you have the rights to everything you send us, including photos taken by someone else, and that your menu content is accurate and not misleading.

Video production

Depending on your plan, dish video is either filmed by a local creator we arrange, or generated from photographs you already have. Filming requires reasonable access to your kitchen and dishes at a time we agree in advance.

Video we produce for you is licensed to you for use on your PlatePost menu and your own marketing. We retain the right to use it as a portfolio example, subject to the same opt-out as above.

AI features

PlatePost includes AI features — an assistant that answers guest questions about your menu, an assistant that helps you make menu changes, drafted descriptions, and drafted dietary tags. These are helpful, not infallible.

You are responsible for reviewing what the AI produces before it goes live, especially anything touching allergens, ingredients, or price. AI-drafted allergen and dietary tags are a starting point, not a substitute for your own kitchen's knowledge.

Acceptable use

Don't use PlatePost to publish anything unlawful, deceptive, or infringing; don't try to break, overload, or reverse-engineer the service; and don't resell it or pass it off as your own product without a written agreement with us.

We can suspend or close an account that breaks these rules, and we will explain why when we do.

Availability

We work hard to keep menus up — a menu that's down is a table that can't order. We do not, however, promise uninterrupted service, and we may need to take the service down for maintenance. Where we can plan it, we will give notice.

Liability

PlatePost is provided as-is. To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential losses, including lost profits or lost sales.

Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.

Ending the agreement

You can close your account at any time. We can end the agreement if you break these terms or persistently fail to pay. On termination your menu stops being served, and you can ask us for an export of your content before we delete it.

Changes to these terms

If we change these terms materially, we will update the date at the top and email the account owner. If you keep using PlatePost afterwards, the new terms apply.

Governing law and contact

These terms are governed by the laws of the State of California, and the courts of California have exclusive jurisdiction over any dispute.
